NOTICE OF DECISION TO PASS ZONING BY-LAW # 2014-17

EXPLANATION OF THE PURPOSE AND EFFECT OF THE APPLICATION

Zoning By-law 2014-17 was passed by Township Council on Monday Mach 24, 2014 amending Zoning By-law 79-14, as amended.

This By‑law involves is a general amendment to the Township of West Lincoln Zoning By-law 79-14.  The purpose of this by-law is to ensure compliance with the Federal Government's Marihuana for Medical Purposes Regulations. 

This By-law allows for medical marihuana growth and production facilities to be located in the Agricultural 'A2' Zone and the Industrial 'M1' Zone, subject to a site specific zoning amendment.  This by-law also amends the Definitions Section of the Zoning By-law to recognize medical marihuana growth and production facilities.

THE PROCESS

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

If you do not agree with the Council's decision, you should send a letter (Notice of Appeal) forthwith to the Township Clerk, Township Offices, stating your objections and the reasons for your objections along with the $125.00 fee required by the Ontario Municipal Board (made
payable to the Minister of Finance).

Effective September 1, 2006, the Board will no longer accept personal cheques; the Board will only accept filing fee payments by certified cheque or money order.  If you wish to appeal to the OMB, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca.

No person or public body shall be added as a party to the hearing of the appeal unless, before the By-Law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

If there are no objections to the Council's decision, there will be no Public Hearing by the Ontario Municipal Board and the By-law will be approved upon the expiration of the twenty (20) day period for filing notices of appeal with the Township Clerk. Please note the last day of appeal is Wednesday April 16, 2014 at 4:30 p.m.

Please be advised that a copy of Zoning By-law 2014-17 will be available at the Municipal Office and will be posted on the Township's website (www.westlincoln.ca). The complete Zoning By-law 79-14 is also available on the Township website or at the Municipal office for public inspection during regular office hours.

Public Notice – Winter Event and Winter Control

As residents of West Lincoln have experienced larger than normal Winter Weather events this season, the Township of West Lincoln would like to provide the public with an update as to snow removal operations when a Winter Snowfall or Winter Weather Warning is underway.

When such events take place, Township forces deployed for snow removal operations as soon as possible. Please be advised that during the continued snow event(s), some delays may be experience.

For snow clearing operations, we are committed to meeting or exceeding Ontario’s Ontario Minimum Maintenance Standards. In order to provide the public with an understanding of the standards we are providing some information regarding requirements under these standards. The Ontario Minimum Maintenance Standards are based on road classifications as set out by traffic volumes and road speeds.

It is important to note that the Township of West Lincoln has Class 3 through 6 roads in its overall network of roads. Once a snow event has ended, snow removal must be completed to a maximum depth and within the hours outlined in the table.

During major snow events, every effort will be made to complete a first pass. However, where necessary, Primary Roads (Class 3 roads) will be given a high priority throughout the event.

We request your patience while we continue to keep our forces engaged during snow events, and as we continue to provide the best possible service.

 

Snow Fence Installation:

In certain open rural areas snow fencing may be installed to assist in the prevention of drifting. Please be advised that several considerations determine these locations. Snow fencing is generally installed on the west side of roads. A minimum setback from the road is typically 12 metres to 18 metres. Snow fencing can only be installed before the set in of frost and only after the removal of crops.  

Snow fencing is currently installed at the following locations:

  1. Twenty Road South Side at South Grimsby Road 8
  2. Port Davidson Road (west side) just South of Regional Road 14
  3. Port Davidson Road (west side) halfway between Regional Road 14 and Bridge
