NOTICE OF PASSING OF BY-LAW 2022-32 (Driveway and Entrance Review)

Re:      Notice of Passing to amend Zoning By-law 2017-70 – (By-law 2022-32)

Purpose and Effect of Housekeeping By-law:  

The Township’s Comprehensive Zoning By-law 2017-70 was passed by the Council of the Corporation of the Township of West Lincoln on June 26, 2017.  This By-law amends Zoning By-law 2017-70, as amended, to address permitted driveway and entrance widths in West Lincoln.

By-law 2022-32 was passed in conjunction with Bylaw 2022-31, being the new Driveway and Boulevard Bylaw. This bylaw regulates new driveways, entrances and culverts within the Township of West Lincoln, as well as alterations to existing driveways, entrances and boulevards. A new application process has been put in place as well as monetary penalties for not obtaining the appropriate permits prior to construction. This bylaw can be found on the Township’s website.

A Public Meeting was held on April 11, 2022. No members of the public provided oral comments. Two written comments were received from property owners. No other public comments were received. All comments received were evaluated by staff and Council through their decision see Planning Report PD-43-2022 for more information.

On Monday April 25, 2022 the Council of the Township of West Lincoln passed By-law Number 2022-32 with respect to Driveway and Entrances. It is important that you read and understand all of the implications of this notice and By-law.

If you do not agree with Council’s decision, the last date for filing a notice of appeal is May 25, 2022. The appeal must be filed with the Township Clerk, and must set out the reasons for the appeal, and the specific part of the Comprehensive Zoning By-law to which the appeal applies as well as be accompanied by the required $1,100.00 Ontario Land Tribunal (OLT) fee (made payable to the Minister of Finance).

Effective September 1, 2006, OLT will no longer accept personal cheques; OLT will only accept filing fee payments by certified cheque or money order. If you wish to appeal, a copy of an appeal form is available from the OLT website at https://olt.gov.on.ca/appeals-process/forms/olt-appeal-form-a1-en/

If there are no appeals to these approvals, there will be no Public Hearing by the OLT and the By-law will be approved upon the expiration of the twenty (20) day period for filing notices of appeal with the Township Clerk.  Please note, the last day of appeal is at May 25, 2022, 4:30 pm. 

Only individuals, corporations or public bodies may appeal a decision of the municipality or to the Ontario Land Tribunal (OLT).  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. 

No person or public body shall be added as a part to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council, or in the opinion of the OLT, there are reasonable grounds to add the person or public body as a party.
