Decisions made by Township Council and the Township Committee of Adjustment are appealable to the Ontario Land Tribunal (OLT). Below is a list of ongoing appeals. More information can be found on the OLT website.

  1. OLT Case No. 23-000470: Official Plan Amendment No. 63: On August 11, 2022, the Township of West Lincoln adopted Official Plan Amendment No. 63 (OPA 63) and the amended OPA 63 was later approved by the Niagara Region on April 20, 2023. OPA 63 was subsequently appealed by Phelps Homes Ltd. and JTG holdings, which alleged issues related to conformity with provincial and regional policy documents, natural heritage system, transportation, water and wastewater servicing and the implementation plan. A large portion of the appeal has been settled through an OLT order, however, a number of matters still remain under appeal.
  2. OLT Case No. 25-000150:  Zoning By-Law No. 2025-04: On February 14, 2025, a Notice of Appeal was submitted by Mr. L. Pomerantz, regarding the Township of West Lincoln's Zoning By-Law No. 2025-04, which provided for the temporary use of the property at 9127 Regional Road 20 for the purposes of outdoor rain barrel storage. The appeal sought to extend the temporary use beyond the four (4) months provided for by Council at which point the temporary use was to cease.
    • OLT conducted a Merit Hearing by video conference on June 20, 2025, at 10 a.m.
    • OLT issued its decision on July 30, 2025, allowing for the temporary storage of barrels for three (3) more years, until February 10, 2028. New barrels are permitted to be stored onsite. This temporary solution will be reviewed after the Township finishes its employment study for the area.

  3. OLT Case No. 25-000232:  Interim Control By-Law No. 2025-05: On March 11, 2025, an appeal was filed by Mr. L. Pomerantz against the Interim Control By-Law No. 2025-05, which temporarily suspended land use planning changes while an employment study is undertaken. The appeal alleges that the by-law improperly targets the use of the property at 9127 Regional Road 20. 
    • OLT conducted a Merit Hearing by video conference on June 20, 2025, at 10 a.m.
    • OLT issued its decision on July 30, 2025, that the Interim Control By-law was properly put in place and the Township can continue its planning review without new applications to change the designation or use of the lands. This area is in transition, so the OLT is allowing this business to continue while the Township finishes its land use planning review.
